For vehicle purchases, payment is due in full at the time of sale, unless alternative financing arrangements have been approved and documented. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AS WELL AS ANY WARRANTIES ARISING FROM COURSE OF DEALING, COURSE OF PERFORMANCE, OR USAGE IN TRADE.
Where a vehicle is sold with a manufacturer's warranty, certified pre-owned (CPO) warranty, or extended service contract, the terms and conditions of such warranty are governed by the respective warranty provider, and any claims or disputes regarding warranty coverage shall be directed to the warranty provider in accordance with their procedures. We make no representation or warranty regarding the accuracy, completeness, or timeliness of any vehicle history reports, condition assessments, or descriptions provided in connection with any vehicle. All vehicle descriptions, specifications, images, and pricing on the Site are provided for general informational purposes only and may contain errors, omissions, or inaccuracies.
Our repair and maintenance services are warranted for a period of 12 months or 12,000 miles (whichever occurs first) for parts and labor, unless a different warranty period is specified in the service order. This limited warranty covers defects in workmanship and materials but does not cover damage resulting from normal wear and tear, improper use, negligence, unauthorized modifications, or failure to follow recommended maintenance procedures. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL RTH AUTOS, LLC, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, REPRESENTATIVES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE, THE SERVICES, OR THESE TERMS, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, LOSS OF GOODWILL, LOSS OF USE, LOSS OF DATA, COST OF PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES, PERSONAL INJURY, OR PROPERTY DAMAGE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Our total liability to you for any claims arising out of or relating to these Terms, the Site, or the Services (including any vehicle purchase or service transaction) shall not exceed the total amount paid by you to the Company in the twelve (12) months preceding the event giving rise to the claim, or if no such payment has been made, the sum of one hundred dollars ($100.00 USD). This limitation applies to all causes of action, whether in contract, tort, warranty, or otherwise, and shall survive any fundamental breach or failure of essential purpose of these Terms.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above exclusions and limitations may not apply to you. In such jurisdictions, our liability shall be limited to the greatest extent permitted by law. You acknowledge and agree that the disclaimers, exclusions, and limitations of liability set forth in these Terms represent a reasonable allocation of risk and form an essential basis of the bargain between you and the Company.

Any dispute, controversy, claim, or cause of action arising out of or relating to these Terms, the Site, the Services, or any vehicle purchase or service transaction shall be resolved exclusively in the state or federal courts located in Ashland County, Ohio, and you hereby submit to the personal jurisdiction of such courts and waive any objections based on improper venue or inconvenient forum. You agree that any cause of action you may have with respect to the Company must be commenced within one (1) year after the claim or cause of action arises, or such claim or cause of action shall be permanently barred.
